This agreement is between (name below), (hereinafter “Newborn Care Specialist” or “NCS”), and Blissful Baby Nurse and (name below) (“Client”) is entered ON this date below.

To guarantee the availability of the Newborn Care Specialist, Client agrees to pay 50% of the contract amount at the time of booking. Please make the check payable to Blissful Baby Nurse and mail to 21346 St. Andrew’s Blvd Suite 154, Boca Raton, Fl 33433.

The second payment will be due when the Client's baby arrives. Payment not received within 7 days will automatically be billed to your credit card plus any credit card fees along with an additional 10% of the entire bill for each day that it is late. Your NCS will not return to work until full payment has been received and those missed days will NOT be made up.

If you have already delivered, the total amount is due in full to retain the services.

3. Cancellations

If the NCS leaves the position due to disrespectful treatment by Client or noncompliance by Client to the agreed upon terms, there will be no refunds issued and the remainder of the contract amount will be due immediately.

If the NCS leaves the position without cause, and Blissful Baby Nurse cannot send a replacement, once the contract has started, Client is under no obligation to pay out the remainder of the contract; although, no refund of services provided will be issued.

If Client simply changes their mind for any reason prior to the scheduled start of the contract, Blissful Baby Nurse will retain 100% of the retainer and the remaining amount will be due immediately.

If Client wishes to cancel the contract early, the balance of the contract amount is due in full. The deposit will also remain with Blissful Baby Nurse.

Blissful Baby Nurse and the NCS have the right to terminate this contract at any time, with no consequence to Blissful Baby Nurse, for reasons of neglect or child endangerment by the parents, issue not made clear by Client regarding child care, living or sleeping arrangements for the NCS is falsified, failure of the client to compensate Blissful Baby Nurse for hours their NCS worked, any issues that have been falsified regarding this contract or job, or the NCS feels uncomfortable for any reason.

If a loss of pregnancy or cancellation of adoption occurs, a full refund of the deposit will be refunded to the client.

The NCS is in the Client's home to educate and assist the parents. Should the parents require the NCS to do something the NCS finds ill-advised or dangerous, the NCS has the obligation to report the action to the Child Welfare Protection Department in Client’s state. The NCS will make every effort to educate Client on the issue before taking the aforementioned action. Should the NCS be released from this contract because of her action to protect the child, Blissful Baby Nurse will receive full payment for the entire contract.

Should your newborn come home from the hospital with a feeding tube, monitor, oxygen and/or any other equipment that is designed to help an infant survive, Blissful Baby Nurse has the right to charge an additional hourly rate or to terminate this contract with a full refund of the deposit. This is to be at Blissful Baby Nurse’s discretion. If the hospital/determine that a RN is needed for this position and Blissful Baby Nurse a RN, Blissful Baby Nurse will refund the deposit less one week’s pay.

4. Newborn Care Specialists are Independent Contractors

All Newborn Care Specialists provided by Blissful Baby Nurse are independent contractors who provide services pursuant to their own background, training, means, and methods. None of the Newborn Care Specialists provided by Blissful Baby Nurse are employees or representatives of Blissful Baby Nurse or are under the control of Blissful Baby Nurse as it relates to the methods by which any services are performed. Blissful Baby Nurse does not retain a right to control its Newborn Care Specialists, nor does it exercise control over its Newborn Care Specialists. Client understands that the Newborn Care Specialist is an independent contractor and is not an employee or representative of Blissful Baby Nurse despite the fact that Blissful Baby Nurse arranges the placement of the Newborn Care Specialist and collects payment for services provided by the Newborn Care Specialist. While Blissful Baby Nurse verifies the certification of the Newborn Care Specialist, Blissful Baby Nurse makes no guarantee as to the quality or capability of the Newborn Care Specialist.

5. Newborn Care Specialist Responsibilities

The primary responsibility is taking care of your child and things that pertain to the child such as:

• Bathing (Sponge bath, then Full Bath)
• Feeding
• Dressing
• Changing Diapers
• Cleaning bottles and preparing new bottles when applicable.
• Laundry (only with 24/7 job)
• Maintain nightly log sheets that will track feeding times, ounces, diaper changes, etc..
• Informing and teaching the parents where applicable
• Creating a workable schedule where applicable

If the client would like the NCS to use techniques used in the client’s culture, Client must address these with Jennifer of Blissful Baby Nurse before the contract begins.

6. Mandatory and Hourly Considerations

7. Compensation

• Should the baby/babies require a monitor, feeding tube, or oxygen there will be an additional hourly charge, to be determined.
• Hours may be added to this contract but hours may not be deleted without financial compensation to Blissful Baby Nurse. The contract is dated; and Blissful Baby Nurse will be paid for any days worked or not worked that are agreed upon in this agreement. The Newborn Care Specialist will NOT make up those hours or exchange those “hours.”

9. Communication

Good communication is essential. Discussions regarding the baby’s routine, or other matters will be brought to the attention of Client as soon as they occur. Likewise, if Client has any problems with the aforementioned issues, Client will bring them to the attention of the NCS as soon as they occur. If Client should want to discuss an issue, the NCS does request that both parents be present, if possible.

10. Confidentiality

During the course of employment, the NCS may legitimately see, hear or otherwise become privy to information about the client. It is understood and agreed that all information relating to Client, including but not limited to financial, household or career, is confidential information which may not be disclosed to anyone without the written consent of the undersigned clients or a court order.

11. General Issues

• A Newborn Care Specialist in no way indicates that a “Newborn Care Specialist” is a R.N. or L.P.N. This is only terminology that has been adapted to experienced qualified women who come in and assist mother and her newborn. The term Baby Nurse is not a legal term for a Newborn Care Provider and refers to a R.N or a L.P.N.

• It is agreed that when the NCS is required to be on the premises, she shall be considered to be on duty and active. As this is a night position, when the NCS is not attending to the baby she will be sleeping. The NCS is a very light sleeper and may have the baby’s monitor in her room.

• The NCS will give the client as much notice as possible for a night off, not to be less than 2 weeks unless she is sick or it is an emergency. The NCS will be given all of the holidays off or payment will be paid double to Blissful Baby Nurse if required to work: New Year’s Eve, Valentine’s Day, Mother’s Day, Memorial Day, 4th of July, Labor Day, Thanksgiving, and Christmas.

• If there are animals in the house that the NCS “feels” are jeopardizing the safety or welfare of the newborn or herself, the NCS has the right to ask those animals be kept in a pen, or in a closed off area while she is in the house with the baby/ies. Failure on the client’s part to cooperate will be considered a breach of this contract. The NCS will never take a chance with the life or safety of the newborn, no matter how much you love and trust your animal.

• The NCS will not travel with Client unless prior arrangements have been made through and approved by Blissful Baby Nurse. Should the client go out of town during the NCS contract and take the baby with them, the NCS is not required to go with them; however, Blissful Baby Nurse will be paid for the time they are out of town on the days the NCS is scheduled to work.

• If there is another child in the house who needs care during the night, it is Client’s responsibility to tend to that child. The NCS does not tend to any other children or animals.

• The NCS is not responsible for any household duties.

• The NCS will always pick up after herself, leaving the nursery in the same condition it was upon her arrival.

• The NCS is certified with specific training. It is understood with this contract that she is here to assist and educate the client. Client however has the right to instruct the NCS on how he/she prefers the infant(s) to be cared for. The NCS will comply with the client’s wishes if they do no harm to the infant.

• None of the terms or conditions of this contract should be interpreted to mean that the Newborn Care Specialist is an employee of Blissful Baby Nurse or is under the control of Blissful Baby nurse for purposes of the methods by which services are performed. The terms and conditions of this contract have been discussed with and/or demanded by the Newborn Care Specialist. Client has been fully advised that the Newborn Care Specialist is an independent contractor.

12. Requirements for a Traveling Job

I am hiring the NCS for a job she must travel to.

• Use of a car during her stay. (Unless she has driven her own car to the job site)
• A private room, separate from the baby/ies with a private bath.

• A round trip airline ticket with an open end (most clients choose to utilize their frequent flyer miles for this ticket) Exception would be the NCS is driving to this site. The client would pay for gas, food, and lodging. Any mechanical failure is the responsibility of the NCS.

• Ability to get online or wireless computer access and a TV in the bedroom while on the premises.

• It is understood that Client is providing room and board for the NCS for the duration of her employment. If Client chooses to go out for a meal, they are not obligated to take the NCS with them but should ensure that adequate food items are available for the NCS to prepare her own meal. If the client chooses to ask the client to accompany them, Client accepts financial responsibility for that meal. If the NCS chooses to go out on her own or order take-out, the NCS understands that she is financially responsible for that meal.

• All basic utilities are the financial responsibility of the client, to include basic phone service. NCS agrees to use her cell phone for long distance calls.

13. Requirements for a 24 Hour Job

I am hiring the NCS for an around the clock job.

• Included in a 24/7 job the client will provide the NCS with:
- Room and Board
- Television
- Bed and Bath Linens
- Internet Access
- Food

• Providing full time care 24 hours requires the NCS have a four hour stretch of uninterrupted rest per day, where no childcare duties of any kind will be required. This time off is included in the daily salary.

The rest of the requirements for a 24-hour position are listed above under section 11.

14. Jurisdiction

The terms of this agreement will be constructed to the laws of the state of Florida.

15. Mandatory Binding Arbitration

To streamline and simply the resolution of any dispute, the parties agree that any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be resolved and/or settled by mandatory binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) shall be entered in any court having jurisdiction thereof. The arbitration shall be conducted in Palm Beach County, Florida before a single arbitrator selected by the rules of the AAA, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice in the State of Florida. No party to this agreement will challenge the jurisdiction or venue provisions as provided in this section.

The undersigned Newborn Care Specialist and Blissful Baby Nurse and Client agrees to all of the described herein. This agreement was reached with the mutual consent of both parties.
Only one client signature is required to make this contract valid.
